Grounds for Termination (ELRA Sections 35, 37(2), 39)

As a general rule, the employer must be able to prove that the reason for termination is valid and fair. A reason is deemed to be fair if it is related to the employee’s conduct, capacity or compatibility or based on the operational requirements of the employer.
